Terms of Service
Effective date: 22 April 2026 · These Terms form a binding agreement between you and 4cs BV. Please read them carefully.
1. Introduction
These Terms of Service (the "Terms") govern your access to and use of the SKØØLSKILL website, application, and related features (together, the "Service") operated by 4cs BV ("we", "us" or "our"). By creating an account or using the Service you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not accept them, do not use the Service.
If you are using the Service on behalf of an organisation (a school, class, company, or other entity), you represent that you have authority to bind that organisation and you accept these Terms on its behalf as well.
2. Who we are
The Service is provided by 4cs BV, a private limited company organised under the laws of Belgium, with its registered office at Lindekensweg 3, 2160 Wommelgem, Belgium and enterprise number BE 1014.832.509. You can reach us at [email protected].
3. The Service
SKØØLSKILL is a gamified AI-assisted learning tool. Core features include scanning handwritten or printed notes, automatic extraction of knowledge "atoms", adaptive practice questions, mastery and skill tracking, streaks, quests, classes and leaderboards, deadlines, and an AI tutor called Nova. The Service evolves over time: we may add, change, or retire features in line with section 12.
The Service is provided over the internet. You are responsible for arranging your own compatible devices, internet access, and any third-party accounts (for example, a Google account if you sign in with Google).
4. Your account
You must create an account to use most features. You agree to:
- Provide accurate, current, and complete information when you register and keep it up to date.
- Keep your credentials confidential, not share them with anyone, and not let others sign in as you.
- Notify us promptly at [email protected] if you suspect unauthorised use of your account.
You are responsible for activity on your account unless you have reported its compromise and we have had a reasonable opportunity to act. We may refuse, suspend, or close accounts as set out in section 13.
5. Children, users under 18 & jurisdiction-specific rules
Minimum age — 13. The Service is not offered to anyone under 13 years of age, anywhere. By creating an account or using the Service, you confirm that you are at least 13 years old. If we learn that a user is under 13, we will close the account and delete associated personal data on the schedule described in our Privacy Policy.
EEA digital-consent age. Article 8 GDPR allows each EEA Member State to set the digital-consent age between 13 and 16 (Belgium 13, Italy 14, France 15, Germany and the Netherlands 16, etc.). Where the digital-consent age in your country of residence is higher than 13, a parent or legal guardian must consent to the child's use of the Service below that age. Our stricter internal rule below already covers this in practice.
Parental involvement under 18. Regardless of the local digital-consent age, we require parental involvement for any user under 18:
- During onboarding we ask for the user's year of birth. If the user is under 18, we require them to provide a parent or legal guardian's email address and to confirm that the parent/guardian has given permission for the child to use the Service. We then send a request to confirm parental consent to that email address, with a unique confirmation link that the parent or guardian must activate themselves. The child's account is only fully activated once this confirmation has been received. Without confirmation, access to the Service remains limited.
- We store that email on the child's account as a contact address for the parent or guardian. A parent or legal guardian may at any time ask us to access, export, correct, suspend, or delete the child's account by emailing [email protected].
Contractual capacity. If you are under the age at which you can enter into a binding contract in your country of residence, your parent or legal guardian must accept these Terms on your behalf and is responsible for your activity under the account.
United States — COPPA. The Service is a general-audience product that is not directed to children under 13 within the meaning of the U.S. Children's Online Privacy Protection Act. We do not knowingly accept registrations from, or collect personal information of, children under 13 in the United States.
United Kingdom. For UK users, we operate the Service consistently with the principles of the ICO's Children's Code (Age Appropriate Design Code), and UK GDPR applies in addition to the EU GDPR references elsewhere in our Privacy Policy.
6. Acceptable use
When you use the Service you agree not to:
- Break any law (including copyright, export-control, and criminal law) or encourage others to do so.
- Upload content you don't have the right to upload, including material that infringes someone else's intellectual property, privacy, or image rights.
- Upload malware, attempt to probe or breach the Service's security, bypass rate limits, or misuse authentication tokens.
- Scrape, spider, or make automated requests outside of interfaces we expose for that purpose.
- Reverse-engineer, decompile, or otherwise try to extract source code or model weights, except to the extent this restriction is prohibited by applicable law.
- Use the Service to generate content that is unlawful, defamatory, hateful, harassing, sexually explicit involving minors, or otherwise abusive.
- Cheat, manipulate XP/coins/leaderboards, share accounts, or circumvent age or parental-consent mechanisms.
- Resell, rent, sublicense, or otherwise commercially exploit the Service without our prior written consent.
- Use the Service to train a competing AI model or to create a substantially similar product.
7. Your content & your responsibility
The notes, images, text, messages, and other material you upload or create in the Service ("Your Content") remain yours. You are solely responsible for Your Content and for making sure you have all necessary rights to upload, process, store, and use it through the Service.
You grant 4cs BV a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transmit, transform, adapt (for example run OCR on it, extract atoms, or generate questions from it), and display Your Content strictly to provide the Service to you, to keep it secure, to comply with the law, and to enforce these Terms. This licence lasts as long as we retain Your Content under our retention schedule (see the Privacy Policy) and ends when we delete it.
We will not use Your Content to train our own AI models or sell it. See section 8 for how AI sub-processors handle content.
7.1 Your representations about Your Content
By uploading or creating content in the Service, you represent and warrant that:
- You own Your Content, or have all the licences, consents, and permissions needed to upload it and to allow the processing described above.
- Your Content does not infringe any third party's intellectual property, privacy, image, publicity, or other rights.
- Your Content does not contain unlawful, defamatory, hateful, harassing, sexually explicit material involving minors, or otherwise illegal or abusive material.
- Where the person whose handwriting, face, or voice appears in Your Content is someone other than you, you have the necessary rights or consents to upload it.
7.2 Copyright risk is yours
SKØØLSKILL is normally used for uploading your own handwritten notes, your own photos, or public-domain or openly licensed study material. If you upload material protected by copyright that you do not own and for which you have no licence (for example a scanned page of a textbook, a copyrighted PDF, exam papers, or images from the web), you do so entirely at your own risk and on your own responsibility. The same rule applies where you upload material subject to someone else's privacy or image rights without their consent.
Whether a particular upload is permitted under your national law — for example, under exceptions for private copying, "text and data mining", teaching, research, or private study — is something you must judge yourself. 4cs BV does not review Your Content for legality before you upload it and does not give legal advice about what is or is not permitted.
7.3 Parental responsibility for users under 18
If the user is under 18, the parent or legal guardian who accepts these Terms is jointly responsible with the user for what the user uploads, including any infringement of third-party rights and any violation of applicable law. Parents and guardians are expected to explain to the child what content is appropriate to upload (their own notes and materials they are permitted to use) and what is not.
7.4 Deletion
You can delete individual items of Your Content inside the app, and you can delete your whole account as described in section 13. After deletion, some data may remain in backups on the rotation described in the Privacy Policy, and where we are legally required to keep records (for example invoices, or items subject to a law-enforcement preservation order under section 16).
8. AI features and limits
The Service uses large language models to read scans, match skills, generate practice questions, and power the Nova tutor. We currently send prompts and relevant context to Anthropic, PBC, and to OpenRouter Inc. as a routing layer. Our AI providers are under contract to us and we have not authorised them to train their models on content you send through the Service. Anthropic has publicly committed that Claude API content is not used to train its models by default; you can read its policy at privacy.anthropic.com.
AI output may be incorrect, incomplete, biased, or out of date. You must use your own judgement and verify anything you rely on — particularly for homework, exams, grades, medical, legal, or financial matters. The Service is a study aid, not a substitute for qualified professional advice or for verifying your own course material.
We apply reasonable rate limits and safety filters to AI features. We may throttle, degrade, or temporarily withdraw AI features if our upstream providers have an outage, if abuse is detected, or if the feature becomes commercially unviable.
9. Plans, fees & AI usage credits
SKØØLSKILL is a paid service. Your subscription has two components:
- A recurring subscription fee billed monthly (or on the cadence you select) that gives you access to the Service and a baseline allowance of AI usage, as described on our pricing page at the time of purchase.
- AI usage charges for activity beyond the baseline. AI usage can be billed on a pay-as-you-go basis or drawn down from a prepaid AI credit bundle (sometimes referred to in-app as "gems") that you purchase separately. In-app currencies (coins, gems) are not legal tender, have no cash value, cannot be transferred to other users, and can only be used inside the Service. Prepaid AI credits do not expire for as long as your account remains active. When your account is deleted, unused credits lapse permanently, unless you request a refund before deletion in accordance with section 11.3.
Prices and allowances are shown on our pricing page or at checkout before you confirm the purchase. All prices include VAT where required by law; other applicable taxes are added at checkout. We may change prices for new billing periods; we will give you at least 30 days' advance notice of any price change and you can cancel before it takes effect.
Subscriptions automatically renew at the end of each billing period at the then-current price, unless you cancel before the renewal date. You can cancel at any time from your account settings. We will send you a reminder by email at least fifteen days before each automatic renewal, clearly stating how you can cancel before the renewal date.
10. Payment, taxes & invoicing
Payments are processed by Stripe Payments Europe, Ltd. We do not see or store your full payment card details. By providing a payment method you authorise us (and Stripe, acting on our behalf) to charge it for your subscription fees and any AI usage or credit purchases you make.
If a payment fails, we may retry the charge, suspend paid features, or downgrade your account. You are responsible for keeping your payment method up to date and for any bank fees that result from a failed charge.
We issue electronic invoices compliant with Belgian VAT rules. For EU B2B customers, reverse-charge VAT applies where you provide a valid VAT number at checkout.
11. Right of withdrawal & refunds
If you are a consumer in the European Economic Area, you have a statutory 14-day right of withdrawal under the Consumer Rights Directive (2011/83/EU), as implemented in Book VI of the Belgian Code of Economic Law.
11.1 Waiver for digital content and AI usage
The Service is digital content and digital services supplied instantly on activation. At the time of purchase we ask you to tick a separate, clearly labelled box giving your express prior consent for the Service (and any AI usage you purchase) to start immediately and to acknowledge that you lose your right of withdrawal for digital content and digital services that have already been supplied, in accordance with Article 16(m) of the Consumer Rights Directive. If the box is not ticked at checkout, the full 14-day right of withdrawal continues to apply to digital content that has not yet started to be supplied.
11.2 Subscription fee refunds
If you exercise the right of withdrawal within 14 days of first subscribing and have not yet used the Service, we refund the subscription fee in full using the original payment method within 14 days. Once you have used the Service during the first 14 days (see 11.1), the portion corresponding to actual use is non-refundable; we may refund the unused portion on a pro-rata basis at our discretion.
After the initial 14 days, subscription fees are non-refundable for partial billing periods. You can cancel renewal at any time; your subscription remains active until the end of the paid period.
11.3 AI credit refunds
Prepaid AI credits (for example "gems") that you have not yet consumed can be refunded on request, on the same payment method, where the law so requires or where we agree in writing — typically within 14 days of purchase, provided none of the credits have been used. AI usage that has already been consumed cannot be refunded, because the underlying compute and third-party API costs have already been incurred.
11.4 Legal guarantees
Your statutory rights as an EU consumer — including the legal guarantee of conformity and remedies for non-conforming digital services — are not affected by this section. If the Service does not conform to these Terms, please contact us at [email protected] and we will work in good faith to fix the issue.
11.5 How to exercise the right of withdrawal
To exercise your right of withdrawal, email [email protected] with an unambiguous statement that you wish to withdraw, together with your account email and the order reference. You may, but are not required to, use the model withdrawal form set out in Annex I of the Consumer Rights Directive.
12. Changes to the Service and to these Terms
We may update, improve, restrict, or retire features of the Service over time. Where a change materially and adversely affects a paid feature, we will give you reasonable advance notice and, where the law requires it, a right to terminate with a pro-rata refund for any prepaid period that would be affected.
We may also amend these Terms. For non-material changes (clarifications, typo fixes) the amended version takes effect on publication. For material changes, we will give you at least 30 days' prior notice by email or in-app notice. If you do not accept a material change, you can cancel before it takes effect; continued use after the effective date means you accept the updated Terms.
13. Suspension & termination
You can cancel your subscription at any time from account settings, and you can delete your account by emailing [email protected]. Account deletion is handled as described in the Privacy Policy.
We may suspend or close your account, in whole or in part, if:
- You materially breach these Terms (in particular section 6 — Acceptable use) or repeatedly breach them.
- You fail to pay amounts due and do not remedy the failure within a reasonable period after we notify you.
- We are required to do so by law, a court, or a competent authority.
- We reasonably believe your account is compromised, or is being used to harm us, other users, or third parties.
Except in cases of serious abuse or where the law requires immediate action, we will give you reasonable prior notice and, where feasible, a chance to cure. On termination, sections that by their nature should survive (for example sections 7 second paragraph, 14, 16, 17, 19, 20, 21) continue to apply.
14. Intellectual property
The Service — including our software, user interface, design, trademarks (including "SKØØLSKILL" and our logos), curated skill library, and documentation — is owned by 4cs BV or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose and in accordance with these Terms. No other rights are granted by implication or otherwise.
Feedback you send us may be used by us freely and without obligation to you, provided we do not identify you as its source.
We respect third-party intellectual property. If you believe content on the Service infringes your rights, email us at [email protected] with enough detail to identify the content and your rights, and we will investigate and, where appropriate, act under the EU Digital Services Act.
Illegal content (DSA Art. 16). Any person can also notify us of content on the Service that they consider illegal — including content that infringes IP, is defamatory, harasses a person, is sexual abuse material, or is otherwise unlawful — by emailing [email protected]. Please include (a) an explanation of why the content is illegal, (b) a link or reference sufficient to locate it, (c) your name and email (unless the content concerns sexual offences involving minors, where you may report anonymously), and (d) a statement of good faith belief that the information is accurate. We review valid notices without undue delay, take appropriate action, and inform you of our decision and the reasons for it.
15. Our role as a hosting service & content moderation
4cs BV operates SKØØLSKILL as a hosting service provider within the meaning of Regulation (EU) 2022/2065 ("Digital Services Act", or "DSA"). We store and make available content that users upload, but we do not originate it. You, the user (and, where applicable, the parent or guardian who accepts these Terms on behalf of a minor), are the provider of Your Content.
No general monitoring. In line with Article 8 of the DSA, we are not under a general obligation to monitor Your Content or to actively seek facts or circumstances indicating illegal activity. We do not routinely view the notes, scans, or chat messages in your account. Access by our personnel is restricted, logged, and limited to specific, legitimate purposes (for example: resolving a support request you have opened, investigating a notified abuse report, complying with a lawful order, or safeguarding the security of the Service).
Moderation is complaint-driven. We take action when we receive a sufficiently substantiated notice (see section 14 for the notice channel and required elements), when we otherwise become aware of clearly illegal content, or when our automated safety signals flag specific abusive patterns on the platform. We do not pre-screen Your Content.
Actions we may take. When we decide to act in relation to specific content or an account — because it appears illegal, because it breaches these Terms, or because we are legally required to — we may, proportionately to the issue: (i) restrict the visibility of specific items (for example hide or quarantine them), (ii) delete specific items, (iii) suspend or terminate the account (see section 13), (iv) stop paid services, and/or (v) disclose information as set out in section 16. Where required by Article 17 of the DSA, we will give affected users a statement of reasons for the decision.
Internal complaint mechanism. If you disagree with a moderation decision we have taken about your account or Your Content, you can appeal to us by emailing [email protected] within six months of the decision. We will review your appeal in a timely, non-discriminatory, diligent manner and under the supervision of qualified staff.
Legal basis for hosting liability. Where Your Content is unlawful, our liability is assessed under the conditional hosting-service exemption in Article 6 of the DSA and the corresponding Belgian rules. Nothing in these Terms waives that statutory regime; it stands in addition to any other protection available to us under Belgian or EU law.
16. Law enforcement & legal requests
We comply with Belgian and EU law and cooperate with competent authorities. This section explains when and how we may disclose information about you or Your Content to a public authority, a court, or another third party acting under legal authority.
16.1 Lawful requests we will act on
On receipt of a valid and properly issued request, we may disclose information and/or preserve, remove, or restrict access to content where we are required to do so by:
- a Belgian court order, investigating judge's order, or public prosecutor's request;
- a DSA Article 9 order to act against specific illegal content, issued by a competent judicial or administrative authority of an EU Member State;
- a DSA Article 10 order to provide specific information about one or more identified users;
- a valid European Production Order or European Preservation Order under Regulation (EU) 2023/1543, where applicable;
- a request made under a mutual legal assistance treaty to which Belgium is a party;
- any other legal process that is binding on us under Belgian or applicable EU law.
16.2 What we may disclose
Depending on the scope of the request, we may disclose:
- account identifiers (user ID, email, display name, sign-in provider);
- registration and authentication metadata (IP addresses, timestamps, device and browser information);
- usage logs (actions taken in the account, timestamps, rate-limit events, error logs, billing events);
- content you have uploaded, along with its metadata;
- billing information we hold, except where the payment processor is the sole custodian (in which case we will direct the authority to the relevant processor).
We retain logs and account data for the periods set out in the Privacy Policy (section 9). Where a competent authority serves a specific preservation request, we will preserve the relevant data beyond those periods for the time legally required.
16.3 Voluntary disclosure in emergencies
If we believe in good faith that disclosure is necessary to prevent imminent risk of death or serious physical harm to a person (for example where a user appears to be in acute danger, or where a threat of violence is credible), we may voluntarily provide the minimum necessary information to the competent emergency or law-enforcement authority, in line with Article 6(1)(d) GDPR (protecting vital interests).
16.4 Mandatory reporting obligations
Some categories of content trigger legal duties that operate regardless of these Terms — for example, the obligation to report and preserve evidence of child sexual abuse material. Where such content is identified, we will remove it and comply with all applicable reporting and cooperation duties, including under Belgian criminal law and under the applicable EU rules on the reporting and combating of online child sexual abuse material.
16.5 Notice to users
Where the law allows it, we will notify affected users before or shortly after disclosing their information to a third party, so they can seek legal advice or challenge the order. We will not notify the user where doing so is prohibited (for example, by a gag order), where it would obstruct an ongoing investigation, or where we believe it would endanger a person.
16.6 How authorities should contact us
Law-enforcement authorities, courts, DSA Digital Services Coordinators, and other competent authorities may send requests to [email protected], or by registered post to 4cs BV, Lindekensweg 3, 2160 Wommelgem, Belgium, for the attention of "Legal". This address also serves as the single point of contact required by Article 11 of the DSA for direct communication with Member State authorities, the Commission, and the European Board for Digital Services, and by Article 12 for direct communication with recipients of the Service. We accept requests and communications in Dutch, French, and English.
16.7 Transparency
We keep internal records of the legal requests we receive and our responses. Where required by the DSA or other applicable law, we will publish transparency reporting on content moderation and on government requests.
17. Third-party services
The Service relies on, and sometimes links to, third-party services (for example Stripe for payments, Anthropic / OpenRouter for AI, Google for sign-in). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services, except as set out in our contracts with them and in applicable law.
18. Warranties & liability
We will provide the Service with reasonable skill and care. To the fullest extent permitted by law, and except as expressly stated in these Terms or required by mandatory consumer law, the Service is provided "as is" and "as available". We make no other warranties — in particular, we do not warrant that the Service will be uninterrupted, free of errors, fully secure against every attack, or that AI output will be accurate, complete, or fit for any particular purpose.
Liability caps. To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profit, revenue, goodwill, data, or opportunity, howsoever arising.
- Our total aggregate liability to you under or in connection with these Terms in any 12-month period is limited to the greater of (i) the total amounts you paid us for the Service in the 12 months immediately preceding the event giving rise to the claim, and (ii) EUR 100.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law — in particular, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any rights you may have as a consumer under mandatory Belgian or EU law.
19. Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold 4cs BV and its officers, employees, contractors, and agents harmless from and against any third-party claims, regulatory actions, fines, damages, losses, and reasonable legal costs (including reasonable attorneys' fees) that are the direct and demonstrable result of:
- your breach of these Terms, in particular sections 6 (Acceptable use) and 7 (Your content & your responsibility);
- Your Content, including any claim that Your Content infringes copyright, database rights, trademark, privacy, publicity, image, moral, or any other third-party rights;
- any allegation that Your Content is unlawful (including defamatory, harassing, or abusive) under the law applicable to you or to the affected party;
- your misuse of the Service (including under an account held by a child for whom you are the parent or legal guardian);
- your breach of any applicable law in connection with the Service.
We will give you reasonable notice of any claim for which we seek indemnification and will cooperate reasonably in the defence. We may, at our option, take sole control of the defence and settlement of any such claim at your expense; you may not settle a claim that admits liability on our behalf or imposes any obligation on us without our prior written consent.
This clause does not apply to the extent a claim is caused by our own breach of these Terms, our negligence, or our wilful misconduct, and it does not limit your rights as a consumer under mandatory Belgian or EU law.
Without prejudice to the foregoing, your indemnification obligation under this section is limited to the amount of the damage actually suffered by 4cs BV that results directly from your fault, and in no event covers damage that is partly the result of a failure on the part of 4cs BV itself.
20. Force majeure
Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, strikes, epidemics, government action, internet or power outages, or failure of critical third-party infrastructure. The affected party will notify the other promptly and use reasonable efforts to mitigate the impact.
21. Governing law & disputes
These Terms are governed by the laws of Belgium, without regard to its conflict-of-law rules. If you are a consumer, this choice does not deprive you of the protection of the mandatory rules of the law of your country of habitual residence (Article 6(2) of the Rome I Regulation).
The courts of Antwerp (division Antwerp), Belgium, have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer, you may also bring proceedings in the courts of your country of habitual residence, and we may bring proceedings against you only in those courts, in accordance with Article 18 of the Brussels I bis Regulation.
Online dispute resolution. The European Commission provides an Online Dispute Resolution platform that consumers resident in the EU can use to resolve disputes out of court: ec.europa.eu/consumers/odr. You can also contact us first at [email protected] — we always prefer to resolve complaints directly.
We are not, at this time, committed to using a specific alternative dispute resolution body for consumer disputes, beyond what mandatory law requires.
22. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Service and supersede any prior understanding on the same subject.
- Severability. If any provision is held to be unenforceable, the rest of the Terms remain in full force and effect, and the unenforceable provision is to be interpreted to give effect to its intent to the maximum extent allowed by law.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms, for example in connection with a merger, acquisition, or corporate reorganisation, provided your rights are not materially reduced.
- Notices. Legal notices to us must be sent by email to [email protected] and, for formal legal service, by registered post to the registered office in section 2. We may send notices to you by email to the address on your account or through an in-app notice.
- Language. These Terms are drawn up in Dutch. Only the Dutch version is legally binding. Translations into other languages, including this English version, are provided for information and convenience only and have no binding force. In the event of any conflict or difference in interpretation between the Dutch version and a translation, the Dutch version prevails.
